All signals, research notes, analysis, and content provided through Alpha Pulsx are generated by automated algorithmic systems. These systems use:

Alpha Pulsx, its owners, operators, employees, contractors, and affiliates shall NOT be held responsible or liable for:

  • Missed trading opportunities due to delayed, inaccurate, or unavailable signals
  • Technical failures including but not limited to server outages, software bugs, data feed interruptions, or any other technical issue that prevents you from accessing or using the Service
  • Third-party data provider errors or failures, including errors in market data, pricing data, or financial information from Yahoo Finance or any other data source
  • Actions or omissions of third parties including brokers, exchanges, clearing houses, or other market participants
  • Losses resulting from unauthorized access to your account
  • Market events including flash crashes, trading halts, circuit breakers, or other extraordinary market conditions
  • Any consequential, incidental, indirect, special, or punitive damages of any kind

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF ALPHA PULSX FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO ALPHA PULSX DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS (CAD $100.00), WHICHEVER IS GREATER.

THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION IN THE AGGREGATE, INCLUDING BUT NOT LIMITED TO BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, MISREPRESENTATION, AND ANY OTHER TORT.
